Episode #39 of the Maryland Construction NetworkMCN Podcast 130x130 Brown

In this episode of the Maryland Construction Network Rob Bertazon meets with Ms. Karen Barbour, Founder and President of The Barbour Group – 410-876-9610. Rob and Karen discuss legislation passed in this years’ session of the Maryland General Assembly titled the Subcontractors Equal Access to Bonding Act of 2013.

Legislation was written following issues Ms. Barbour had when clients (subcontractors) would receive bonding for public projects in Maryland from sureties that were approved to do business in the state and satisfied the requirements of the state, but those bonds were sometimes rejected by the Prime Contractor on the project. Prime contractors often require subcontractors to bond back either because of internal protocols or, as requirement of their own surety.

  • Ms. Barbour formed the Coalition for Contracting Fairness in the fall of 2012
    • Members were from small and minority businesses
    • Members were also construction organizations
    • The coalition secured a lobbyist – Gil Genn – Capital Hill Strategic Advocates
    • Language of the bill was drafted
      • The effective message of the bill is that if a Prime Contractor requires a Subcontractor to bond back on a state project, and the Subcontractor furnishes a bond that is produced by a surety licensed to do business in the state of Maryland, and acceptable by the state, the Prime Contractor cannot decline that bond
      • Bond limits acceptable by the state must also be accepted y the Prime Contractor
  • The bill was filed in the Senate (SB 599) and the House (HB 585)
    • Bill sponsors included – Senator Conway,  Delegates Reznik, Bromwell, Costa, Cullison, Donoghue, Elliott, Frank, Frick, Healey, Hubbard, A. Kelly, Kipke, Murphy, Nathan–Pulliam, Oaks, Pena–Melnyk, Ready, B. Robinson, Tarrant, and V. Turner
  • Following some amendments this legislation was unanimously passed in both the Senate and the House
  • The bill was signed by the Governor and the law will go into effect on July 1, 2013
